This event provided a unique opportunity for generation executives in North America to share insights on the most critical issues facing power generation today.
Todd Williams, partner and fossil practice co-leader at ScottMadden, presented on the EPA’s CPP, one of the most significant environmental mandates in U.S. history. He gave an overview of the requirements and impacts of the CPP. He also recapped events now unfolding in CPP litigation, politics, and legislation. Where are the battle lines drawn? Who is on what side? And, what are states doing to prepare their compliance plans?
“This is one of the most significant environmental regulations in U.S. history. Its impact on the U.S. generating fleet will be dramatic. Battle lines are drawn, and we see activity across all branches of government, even extending to the presidential candidates. We believe the ultimate decision will be made in the courts; however, the future President could also have a key role. The timing for implementation is fast; if opponents are not able to derail the regulation early, then the rule’s impact could be felt regardless of an ultimate court decision,” said Mr. Williams. “Additionally, while states currently have the next step in preparing compliance plans, ScottMadden’s recent survey of state regulatory commission web sites indicates that there is less activity and discussion than anticipated. This could be due to state’s taking a wait-and-see approach or just a lack of keeping their web site’s current. Regardless of which side of the battle lines you are on, the unfolding story of this rule is fascinating.”
