There is major debate over the EPA’s Clean Power Plan (CPP), both with respect to the new Trump administration policies and in the federal courts. Whatever the courts decide will influence the options available to the new administration and the fate of the CPP.

ScottMadden’s report reviews the arguments before the D.C. Circuit Court of Appeals on the major legal issues, including:

  • Is the CPP so transformative that it requires Congressional approval?
  • Can a “best system of emissions reduction” under the Clean Air Act go “outside the fence line” of a particular emissions source?
  • Are the goals mandated achievable or will they create potential electric reliability problems?

“In an unusual step, the D.C. Circuit assembled its entire panel of judges en banc to decide these questions, among others, and there is an expectation that this litigation can escalate to the Supreme Court. The course of the CPP through these courts is potentially a key determinant of its fate,” said Todd Williams, partner and fossil practice co-leader at ScottMadden. “President-elect Trump has promised to eliminate the Clean Power Plan. Whether and how an incoming Trump administration will act to eliminate, change, roll back, or respond to the challenge of the CPP in court will be worth watching in the upcoming months,” continued Mr. Williams.
