ScottMadden Discusses Clean Power Plan in Tower Advisory Group Report

ScottMadden, Inc., one of North America’s leading energy consulting firms, recently provided commentary on the Clean Power Plan (CPP) which was included in the October 11, 2016 Weekly Tower Report. This report was showcased at the recent World Energy Forum in New York City—a platform for energy leaders to conduct meaningful discussions about the changing global energy landscape.

Tower Advisory Group principal Bennett Resnik represented the Tower Advisory Group at the forum. The group issues a weekly commentary on a current energy topic in its Weekly Tower Report. A recent commentary focused on the recent en banc hearing for the CPP and what it could mean for the power industry. The CPP is regulation promulgated by the Environmental Protection Agency (EPA), regulating greenhouse gas emissions from existing electrical power generators. On September 27, 2016, challenges to the CPP were heard in the U.S. Court of Appeals for the District of Columbia circuit.

ScottMadden’s comments, featured in the Tower Report, examine the CPP litigation proceedings as well as the two biggest questions the EPA will need to address as an advocate of the plan:

  • Whether “generation shifting” (from coal to lower-emitting sources) is so “transformative” that the CPP requires clear indications of approval from Congress and that the EPA, therefore, does not benefit from its usual judicial deference to administrative rulemaking
  • Whether the EPA’s “best system of emission reduction”—mandated by the CPP—impermissibly goes “outside the fence” in regulating other-than-pollution sources

“In the wake of the presidential election, CPP advocates are eager for new information on the legal status of the plan coming out of these proceedings and how it could impact the power industry in 2017,” said Greg Litra, partner and energy, clean tech, and sustainability research lead at ScottMadden.
