ScottMadden, Inc., one of North America’s leading energy consulting firms, recently released its newest edition of The Energy Industry Update. This semi-annual publication offers our inside view of major events and emerging trends in the energy industry, including the EPA’s coal combustion residuals (CCR) rule.
In April 2015, the EPA formally published its final CCR rule, which regulates the disposal of CCRs from active electric generating units as nonhazardous waste under Subtitle D of the Resource Conservation and Recovery Act. On October 14, 2015, the rule became effective.
This rule establishes minimum criteria for CCR landfills and CCR surface impoundments at plant sites. If they fail to meet these criteria, sites must retrofit or close. This rule will require owners and operators to follow a programmatic approach to build an effective compliance strategy, resulting in a master strategy for each site and organizational capabilities to ensure effective management.
